Mr. Derksen works with a broad range of clients in real estate and transactional matters, including:
- Representing developers, contractors, subcontractors and owners in the negotiation and drafting of development agreements, construction contracts, easements and co-ownership agreements.
- Advising buyers and sellers in the purchase, sale and financing of real property.
- Structuring and preparing leases, options and build-outs on behalf of landlords and tenants.
- Real estate workouts and restructurings (in and out of bankruptcy).
Mr. Derksen also has extensive experience in representing closely held businesses and their owners with respect to entity structure and formation, operational, and other transactional issues, including shareholder and limited liability company operating agreements, asset and stock purchase and sale transactions, due diligence, financing, and ownership/buy-out disputes.
In addition, Mr. Derksen represents bankruptcy trustees, creditors and commercial debtors in bankruptcy. He also has substantial experience in representing court appointed receivers and regarding creditors’ rights in the context of probate and trust administration.
